These Terms of Service form a binding agreement between you and IT Custom Solution LLC, doing business as OpsTicket. By creating an account, accessing the service, or: in the case of recruiters or enterprise customers: executing an order form referencing these Terms, you accept them.
If you are accepting on behalf of a company, school, or government entity, you represent that you have authority to bind that organization. “You” means both you and that organization, unless context requires otherwise.
These Terms incorporate our Privacy Policy and, where applicable, our Data Processing Agreement.

You may create one personal account per individual. Users must be 13 or older. Education-tier users aged 13 to 17 require either institutional consent (school-verified account under FERPA) or verifiable parental consent under COPPA. Sharing credentials, automating accounts, or creating accounts on behalf of someone else without consent is grounds for termination.
You are responsible for all activity under your account until you tell us a credential is compromised. We support MFA and strongly recommend you enable it: particularly for recruiter and admin accounts.
We may suspend an account for the safety of the service or its users; where the cause is not abuse, we will give you reasonable notice and an opportunity to cure.

OpsTicket is free for individual candidates. This is a deliberate commercial decision: candidates are the labor side of the marketplace, and a paywall would change who participates. There is no paid candidate tier, no boost-your-profile fee, and no commission on hires.
Your profile and any sessions you have published belong to you under §08. If you stop using the product, we will notify you before deactivating your profile, and we will give you a 30-day window to download or delete your data.

Recruiter access is licensed on a per-seat, per-month basis under the order form or self-serve plan you select. A “seat” is a single named user. You may reassign a seat to a new user no more than once every 30 days; you may not share credentials.
Reasonable-use limits apply to search and outreach to prevent abuse of the candidate side of the marketplace. These limits are published in your admin console; we will notify you in-product before any limit changes adversely.
Custom scenario development, ATS integrations, and SSO are available on the Enterprise plan and governed by your order form.

Cheating: including answer-sharing, solving on behalf of another candidate, or using disallowed tools: results in score invalidation and account termination. AI-generated scores are final, but candidates may request a human review of any specific scoring decision.

You agree not to:
We may remove content or suspend accounts for violations. For severe or repeated violations we may terminate without refund.
// plain languageThe product is ours. The scenarios are ours. The way you solved a scenario is yours. Logos are off-limits without permission.
OpsTicket retains all right, title, and interest in the service, including the scenario library, rubric, software, brand, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service per these Terms.
The scenario prompts, rubrics, and expert paths are our copyrighted material. You may not republish them, post them to public repositories, or feed them into a third-party training set.
Marks. “OpsTicket,” the ticket-mark, and related logos are trademarks of IT Custom Solution LLC. Limited fair-use mentions (e.g., “Verified on OpsTicket”) are permitted; design-quality treatments require a brand kit and our written permission.
// plain languageYou own your sessions. We need a narrow license to host them, score them, and show them to recruiters you have approved.
You retain ownership of any content you submit: responses, written reasoning, profile copy, uploads. You grant OpsTicket a worldwide, non-exclusive, royalty-free license to host, reproduce, and transmit that content solely to operate the service, score your submission against the rubric, and make sessions available to recipients you have authorized.
You can revoke a recruiter’s access at any time from Settings. Revocation is forward-looking; it does not retract copies the recruiter may already have legitimately viewed.
We may produce anonymized aggregate statistics from submissions (e.g., median time-to-solve across all candidates on a given scenario). Aggregate data does not identify you and is not your content.

Fees are stated on your order form or the published price list. Recurring fees are billed in advance for the following term and are non-refundable except as stated in this section or required by law. Taxes are your responsibility unless we collect and remit them on your behalf.
We offer a goodwill refund of the most recent monthly invoice if you cancel within 14 days of your first paid invoice: email [email protected].
We may change prices on renewal with 60 days’ notice. Price changes never apply mid-term.

School accounts have FERPA protections. Student data belongs to the institution. Schools can request student-data export or deletion at any time. OpsTicket acts as a school official under FERPA and only uses student data to operate the educational service.

You may terminate by deleting your account in Settings or, for recruiters, by writing to [email protected]. We may terminate for material breach not cured within 15 days, for non-payment after notice, or immediately for serious abuse.
On termination we will give you 30 days to export your data, after which it will be deleted per §08 of the Privacy Policy. Sections that by their nature should survive termination (IP, payment of accrued fees, disclaimers, liability, governing law) survive.

EXCEPT AS EXPRESSLY STATED, OPSTICKET PROVIDES THE SERVICE “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
We do not guarantee that a recruiter will see your profile, that a candidate will accept an outreach, or that any particular hiring outcome will result from use of the service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS.
EACH PARTY’S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (i) US$100, OR (ii) THE FEES YOU PAID OPSTICKET IN THE TWELVE MONTHS PRECEDING THE FIRST EVENT GIVING RISE TO LIABILITY.
The cap does not apply to: a party’s indemnification obligations, breaches of confidentiality, infringement of the other party’s intellectual property, fraud, gross negligence, or amounts owed for the service.

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for any dispute that cannot be resolved informally.
If you are a consumer in the EU or UK, this section does not deprive you of the protections of your local consumer law, and you may bring proceedings in your local courts.
If any provision of these Terms is held unenforceable, the rest survives. Failure to enforce a right is not a waiver.
